  • 1. Primary renter must be at least 25 years of age (Municipal Code 5.25.030). Proof of Age Required. ** Guest represents he/she/they are or will be 25 years of age or older by the first day of occupancy, and further warrants that other occupants are either over the age of 25 or are accompanied by an adult guardian. 2. LATE CHECK OUTS / NON-APPROVED LATE CHECK OUTS Guest agrees there shall be no non-pre approved late check outs, or vacating the premises after 10 AM without a pre-approval. - Late Check Out: Occurs after 10:00 am on the day of departure. Unless pre-approved by ACME. The Cost to extend Check Out on the day of departure may be up to ½ daily lodging fees charged to Guest’s credit card on file (which will not be deemed a limitation of damages). - Non-Approved Late Check Out: Occurs after 10:00 am on the day of departure. Cost for a non-pre approved late checkout is 2 times the daily high season lodging rate, and taxes, plus any costs incurred, including but not limited to relocation of arriving guests, which will be charged to Guest’s credit card at ACME's sole discretion. 3. CONDITION OF PREMISES - Accuracy of listing: Furnishings, amenities and decor are subject to substitution or change without notice. ACME photos of the Premises may not exactly represent recently made changes. - Guest Responsibility: On arrival day, Guest agrees to examine the Premises and its contents entirely, including cleaning quality, and promptly report any items that are unclean, damaged, not functioning, or missing. These issues do not give Guest the right to cancel the Agreement or receive a refund or discount, whether reported or not. - Emergency Items: Reporting of COMPLETE non-operation of main house refrigerator, HVAC systems, water heating systems, pool heating equipment (not spa), entire electrical systems, gas or water leaks, or roof leaks over beds, will be treated as an emergency by ACME. Depending on availability, it could take from 1 hour, to 24 hours, to make these repairs. If repairs cannot be made within 24 hours, ACME, at its sole discretion, may remedy by any or none of the following: 1. Move Guest and other Occupants to a different property. 2. Offer a full or partial refund - Non-Emergency Items: Amenities such as TV's and media, small appliances, furniture, garage door, gates, are fixed as quickly as possible, are not considered emergencies. Items not listed in subsection c. above are not treated as emergencies. No refunds or relocations are given on unavailability of non-emergency items or conditions. 1. Problems may occur, as they do at your own home. Items may break or fail during your stay, our promise to you is that we will do our best to rectify issues as soon as reasonably possible and commercially practicable after we become aware of the condition. 4. POOL HEATING - prices vary (please inquire about pricing). If your home has a spa or jacuzzi, this is can be heated at no charge (Please note: Pool heating may be added in a minimum of 3 day blocks). 5. PETS: Are you bringing a Pet? A signed Pet Addendum and pet fee will be required. ** If evidence of pets are found without prior permission and without a signed Pet Addendum, a $1,000 fee will be charged to your credit card, or withheld from your Security Deposit. Additionally, any pet-caused damage to the home, yard or furnishings will be handled as intentional damage, not covered by damage waiver, and subject to additional charge to Guest’s credit card ** 6. ENTRY ACME and its representatives and agents reserve the right to enter the Premises at any time. Generally, but without limitation, access is made: (i) for maintenance or for the supply necessary or agreed services; (ii) verifying the Guest and all Occupants have complied with the terms of Agreement, to investigate disturbances, or to check for damages; or (iii) in case of emergency. From time to time there may be maintenance and service companies such as but not limited to Pool Cleaning, Gardeners/Landscaping, Postal Service, Pest Control, Solar, Plumbing, Electrical, HVAC that may arrive and need access to the Premises, which access must be allowed by Guest. Companies may directly access the backyard without notice. Providing access to the property does not entitle the Guest to a refund. Additionally, ACME has a remote garage delivery system setup for packages–delivery companies have access to open the garage door and place packages inside. Best efforts are made to have deliveries made when the home is vacant; however, once an order is on the way, stopping it is not practical .Therefore, Guest understands and agrees that garage deliveries may occur during their stay and accepts the possible interruption this may cause. 7. REFUNDS FOR FAILURES OR OTHER ISSUES ACME is a “high service agency” investing in maintenance and staff to prevent and shorten the duration of issues at the Premises and/or failures while guests are on the Premises. This high service model is thorough and expensive. In the event ACME determines in its sole but commercially reasonable discretion that an issue or failure at the Premises is material in its impact on Guest’s stay and not otherwise subject to the relocation. ACME will provide a refund of not less than 15% nor greater than 25% of the total of Nightly Lodging paid by Guest (exclusive of all other fees), plus any taxes applicable. Such refund shall be deemed in full satisfaction of Guest’s issue or failure. In consideration of such a refund, Guest agrees not to post any review about a stay issue and/or failures. 8. ACTIVITIES OUT OF OUR CONTROL AND NEIGHBORHOOD CONDITIONS: Like your home, our homes are located in a city where there are at times neighbors completing construction or causing noise or other disturbances, city street work, or temporary service or utility interruptions for upgrades, outage, or repairs by the utility and other provider companies. While we have no control over such circumstances and other disturbances, we do our best to ensure that guests are informed during planned work or outage events which we become aware of in advance. However we do not treat any such disturbances or outages as refundable events ** Please Note ** Guest is advised to satisfy him or herself as to neighborhood or area conditions, including schools, proximity and adequacy of law enforcement, crime statistics, proximity of registered felons or offenders, fire protection, other governmental services, availability, adequacy and cost of any wired, wireless internet connections or other telecommunications or other technology services and installations, proximity to commercial, industrial or agricultural activities, existing and proposed transportation, construction and development that may affect noise, view, or traffic, airport noise, noise or odor from any source, wild and domestic animals, other nuisances, hazards, or circumstances, facilities and condition of common areas, conditions and influences of significance to certain cultures and/or religions, and personal needs, requirements and preferences of Guest. 9. UTILITIES Guest is charged for estimated daily use for electrical and gas, included in the nightly rate you pay. Air conditioning can be set as low as 74 degrees. The house heater can be set as high as 82 degrees. Spa heating is included. Pool Heating can be added to your reservation for an additional nightly rate. 10. RULES AND REGULATIONS Guest agrees to comply with any and all rules and regulations that are at any time posted on the Premises, contained in this Agreement, or otherwise delivered to Guest. Guest is responsible for ensuring that all other Occupants and Visitors comply with the same. Additional rules and regulations may apply if the Premises is located in a condominium complex or subject to a Homeowners Association (HOA) or community association. 11. NO ASSIGNMENT OR SUBLETTING Guest shall not assign any interest in this Agreement or any right to occupancy of any part of the Premises, and any attempt to do so shall be void and ineffective, and shall result in termination of this Agreement and occupancy of the Premises. In the event of such termination, ACME shall be entitled to retain all sums paid by Guest. 12. UNAVAILABILITY OR RELOCATION If for any reason the Premises are unavailable, ACME or Guest may cancel this agreement. In this event, a full refund will be made immediately to Guest, of all payments made. At Guest’s request, commercially reasonable effort will be made to substitute a property of equal or greater size and quality. If additional funds are required to secure an alternate property, ACME will require payment from Guest before permitting arrival at alternate property. 13. PERSONAL PROPERTY AND INJURY All of the units are privately owned; the owners are not responsible for any belonging losses, accidents, injuries or illness that occurs while on the premises or its facilities. By accepting this reservation, it is agreed that Guest and all Occupants and Visitors are expressly assuming the risk of any harm arising from their use of the Premises or others whom they invite to use the premise. 14. NON-INSURED: Personal property, including vehicles, brought to the Premises by Guest or other Occupants or Visitors is not insured by ACME, home owners, homeowner's association, or ACME’s agents, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others or any other cause. ACME, home owners, homeowners association, or ACME’s agents, do not insure against personal injury to Guest, Occupants, Visitors, or licensees, resulting from any cause or reason. 15. AMERICANS WITH DISABILITIES ACT Due to building codes applicable to residential homes not requiring full handicap accessibility, as well as the age of many homes, ACME vacation lodging homes ARE NOT ADA compliant. Please call us with any questions on accessibility. Please ask for the owner or general manager, not reservation staff. 16. POOL AND SPA USE: Guest and all other Occupants and Visitors, acknowledge that they have INTENTIONALLY ELECTED to stay in Premises that includes POOL AND/OR SPA AMENITIES. ** GUEST AND ALL OCCUPANTS AND VISITORS ACKNOWLEDGE THAT POOL AND SPA AMENITIES CARRY INCREASED RISK FORPOTENTIAL PERSONAL INJURY AND/OR DEATH DUE TO, BUT NOT LIMITED TO, THE FOLLOWING WHICH IS NOT INTENDED TOBE AN EXHAUSTIVE LIST OF RISK ** 1. Drowning, associated with immersion in water. 2. Falling injury/subsequent drowning associated with hard surfaces surrounding the pool and spa (and indoors with wet floors following swimming) which may become slick because of water on those surfaces, a risk particularly enhanced by horseplay and careless behavior. 3. UNSUPERVISED CHILDREN are particularly susceptible to the dangers inherent in the use of the pool and spa amenities. 4. The risk of drowning is enhanced by the USE OF ALCOHOL, and such use is not recommended before or during the use of the pool and spa amenities. The effects of alcohol may be enhanced by dehydration and desert heat. 5. The spa may be set higher than 98 degrees, and prolonged immersion in such temperatures can result in overheating of the body and subsequent medical complications, including death. 6. Spa heat can also result in unintentional loss of consciousness or falling asleep, which can result in drowning/death. This danger is accentuated by the use of alcohol. Guest, Occupants, and Visitors acknowledge that ACME provides NO SUPERVISION or other protection against the inherent risks associated with pool and spa use, whether by an Occupant, their children or their Visitors, and accept full responsibility for the increased level of care and potential injury associated with these amenities. Guest, Occupants, and Visitors further acknowledge that DIVING ISABSOLUTELY PROHIBITED in both the pool and the spa–neither is of sufficient depth or design to accommodate diving. Diving will likely result in INJURY or DEATH. 17. CRIMINAL ACTIVITY All criminal activity, including but not limited to the possession or use of illegal drugs at the home is strictly prohibited, and such criminal activity shall cause occupancy to be terminated. In case of such termination, without limiting any other right or remedy, ACME shall retain such sums as have been paid by Guest. WELCOME TO PALM SPRINGS! Palm Springs is world-famous for the special welcome people experience while on vacation here. Please enjoy your stay with ACME! We are pleased you have chosen to spend your vacation in our City. There is so much to see and do. Or, if you choose, just sit back, relax and do nothing at all. Like many of our visitors, you have decided to rent a house or a condominium for your own special experience. That’s great. There are many benefits to doing that. Perhaps the greatest benefit is the pleasure of residing – even for a short stay – in one of our residential neighborhoods. You will be among many permanent residents who value the look and feel of a quiet and safe place to live. They, and the City, will look to you for your help in preserving that special sense of peace and quiet. In short, being a vacation renter also means being a good neighbor. GOOD NEIGHBOR INFORMATION PROVIDED BY THE CITY WITH VACATION RENTAL RULES HOW MANY IS TOO MANY? Please refer to the stated maximum occupancy for your rental in the listing. You are allowed 2 adult overnight guests per bedroom (unless otherwise stated), 2 children (under the age of 12) and an additional (4) **Daytime Guests ** Daytime guests hours are from 10am - 10pm. Compliance with these rules will ensure you and your neighbors enjoy your stay. WHAT ELSE SHOULD I KNOW? It is important to be a good neighbor – whether you’re at home or on vacation. Please remember that you may be cited or fined by the City or even evicted for creating a disturbance or violating the City’s Vacation Rental Ordinance. The surrounding neighbors have been given a 24-hour number to call should they need to file a complaint. WHAT YOU NEED TO KNOW This information is intended to highlight a few ways you can be a good neighbor during your stay in Palm Springs. WHO’S MAKING ALL THAT NOISE? Please do not create noise or disturbances or engage in disorderly conduct. Consider how you would want your neighbors to behave in your own neighborhood. Chances are your Palm Springs neighbors will expect the same of you while you’re here. A little consideration goes a long way. Keep in mind that amplified music is not allowed outside of your vacation rental unit. So, please, don’t bring the speakers outside and crank up the music, even if you think everyone will enjoy your excellent taste in music. A call from the neighbors to the City will bring the Police to your door. So please, keep the noise down. Our officers can issue you a citation if you violate the City’s noise ordinance. ** NO MUSIC or SOUND (TV, Cell phone radio, etc) are allowed outside at any time. Any type of SOUND from any sound producing device is not allowed outside of your Vacation Rental unit. This includes music coming from inside of the home that can be heard outside. If your neighbors can hear the noise, you are in violation of the City Ordinance ** POOL TIME - Please keep voices and pool activities to a reasonable level. Continued and ongoing screaming for an extended period of time is one way to disturb the neighbors. WHOSE CAR IS THAT? Please, also be mindful of where you park. Park in the garage, on the driveway, in your assigned space or as close to where you are staying as possible. But in any case, don’t block anyone’s driveway. Your car could be towed. Please note: Per City Ordinance, the number of vehicles that can be parked at a property at any given time is limited to only one (1) vehicle per bedroom. For example, a 4 bedroom home you can have up to 4 parked vehicles (including visitors). No work trucks, RVs, trailers, or any other non-standard passenger vehicles are allowed. ** You are allowed 1 CAR PER BEDROOM (including any daytime guests) at your vacation rental ** Should you have extra vehicles, you must park them in another location away from the home. ** PUPPY LOVE Palm Springs requires that all dogs be on leashes whenever they are outside, except in the City’s Dog Park. Also, we expect everyone to pick up after their pet. Never leave your pet unattended in a vehicle; it is illegal all year long. And just like at home, a barking or whining dog disturbs the neighbors. WHOSE TURN IS IT TO TAKE OUT THE TRASH? Palm Springs residents recycle as much as they can and we hope you will too. If you have a blue recycling cart where you are staying, please use it to recycle metal, paper, glass and plastic products. Please do not store trash and refuse within public view, except in proper containers for the purpose of collection. If you are staying in a house, Palm Springs Disposal Services will pick up your trash and empty your recycling cart on your scheduled collection day(s). Please do not leave trash or recycling at the curb. By reserving this home the guest agrees to the following: 1. I have read and I will comply with all the Rules and Regulations stated in the Good Neighbor Brochure. 2. I understand that I may be issued an Administrative Citation by the Vacation Rental Compliance Officer, Palm Springs Police Department or their agents for not following City of Palm Springs Vacation Rental Rules and Regulations. 3. I understand the City of Palm Springs may request eviction of all the guests from the property by the agent and/or owner should any occupants in the rental party continue to violate Rules and Regulations. 4. I agree that the Responsible Person is the individual on the Rental Contract. Responsible Person is the individual who is held responsible for the actions of all guests in their rental party. 5. An Agent or Owner or their representative has explained the Rules and Regulations prior to or within 24 hours of my Vacation Rental property occupancy.
